New Zealand’s Online Gambling Bill timeline
Draft legislation is expected to be released as early as April 2025 for assessment and consultation, with new licences to be in operation by April 2026. Government is separately developing the operational aspects of the regulatory system that will apply, including the processes to support licensing and monitoring of operators.
Licences, will operate for a period of 3 years, and be awarded as part of a two-stage process.
Stage 1: Initially, interested parties will be assessed for probity and suitability.
Stage 2: Approved applicants will be eligible to participate in an auction process.
About the Bill and proposed online gambling measures
One of the anticipated measures in the Bill is the introduction of a mandatory levy on licensed operators' profits. This levy will contribute towards funding for problem gambling support services and education programs. This will not only help those affected by problem gambling but also promote responsible gambling practices among the general public.
A similar levy structure has recently been implemented in Australia’s Northern Territory under the new Racing and Wagering Act 2024 (NT) which came into effect on 1 July 2024. The levy will apply in addition to an anticipated tax of 12% on gross gaming revenues.
The regulatory framework will also detail mandatory age verification processes to prevent underage individuals from accessing online gambling websites. Operators will be required to have robust systems in place to verify their customers' identities and ages before allowing them to transact.
As a reflection of the stricter legislative requirements, operators that are granted a licence under the new legislation will be subject to regular audits and inspections to ensure they are compliant. Any operator found violating these regulations may face penalties such as fines or revocation of their licence.
